1. Introduction and Agreement

These Terms of Service ("Terms") are a legally binding agreement between you and House And Land Packages Pty Ltd (ABN 92 631 641 408) ("HALP", "we", "us", or "our"). By accessing or using any HALP website, platform or service, you agree to be bound by these Terms.

For advertisers (including agents, builders and developers) these Terms also include the Listing Agreement, which is incorporated by reference. In the event of any inconsistency between these Terms and the Listing Agreement regarding listing specifics, the Listing Agreement prevails.

1.2 Our Platforms

These Terms apply to all HALP platforms including www.halp.com.au, www.boutiquedevelopments.com.au, associated mobile applications, and any related sites, features or services within our network.

1.3 Acceptance of Terms

By accessing or using our services you acknowledge that you have read and understood these Terms, agree to be bound by these Terms and our Privacy Policy, represent that you are at least 18 years of age, and represent that you have the authority to enter into this agreement.

1.4 Changes to Terms

We may modify these Terms at any time. We will update the "Last Updated" date, notify registered users by email, and display material changes prominently. Continued use of our services after changes take effect constitutes acceptance.

2. Description of Services

HALP operates specialised property discovery and business directory platforms providing house and land listings, off-the-plan and new development information, school-zone integration, calculators and tools, mortgage broker connections, market insights, business directory listings (freemium), lead generation for advertisers, and supporting services such as alerts, favourites and educational content.

HALP is an information and advertising platform. We are not a real estate agent, developer, builder or financial advisor. Property listing inquiries you submit go directly to the listing agent, developer or builder, and HALP does not store or access those inquiries. Inquiries you submit through our own Contact Us, Join Us and Advertise With Us forms are managed by HALP in accordance with our Privacy Policy.

We do not act as your agent, provide property, financial, legal or tax advice, or guarantee the accuracy of third-party listings. Services are provided "as is" and "as available" and may be modified, suspended or discontinued at any time.

3. User Accounts and Registration

To access certain features you may need to create an account. You must provide accurate, current and complete information, keep your credentials confidential, be at least 18, only create one account per person and hold a valid ABN/ACN for business accounts. You are responsible for all activity under your account and must notify us of any unauthorised access. We may suspend or terminate accounts that breach these Terms, provide false information, engage in fraud, fail to pay fees or remain inactive for an extended period. You may terminate your account by contacting support@halp.com.au.

4. User Conduct and Prohibited Activities

You agree to use our services lawfully and in good faith. You must not use automated systems without authorisation, interfere with the platform, gain unauthorised access, reverse-engineer components, or circumvent security. You must not post false, misleading or deceptive information, upload harmful code, spam, phish, impersonate others, violate intellectual property, engage in fraud or money laundering, harass or discriminate against other users, resell our services without authorisation, use our platform to compete with our business, or create multiple accounts to circumvent restrictions. Violations may result in suspension or termination, content removal, legal action and permanent bans.

5. Property Listings and Information

Property listings are provided and owned by third parties (developers, builders, agents and project marketers). HALP does not own or verify all listings and does not endorse or guarantee any property. Information may change without notice — prices, availability, specifications, images, dimensions and school zones are approximate and subject to change. Always verify critical information directly with the property provider before making decisions. We expressly disclaim all warranties regarding accuracy, completeness, availability, fitness for purpose, title or condition of properties.

School Zone Information

School zone data is sourced from government and third-party databases and is provided for general reference only. It is subject to change without notice. Always verify catchment zones directly with the relevant education department and the specific school before making a property decision.

6. Business Directory Listings

To advertise you must hold a valid ABN or ACN, be a legitimate operating business, comply with all applicable laws, and hold necessary licenses. Business listings must accurately describe your services, use your own name and logo, comply with Australian Consumer Law and not contain misleading claims. Listings must not promote illegal goods or services, make unsubstantiated claims, violate professional codes, engage in bait advertising, contain discriminatory content or infringe third-party IP.

Free listings provide basic directory presence. Premium subscriptions provide enhanced features, require payment, auto-renew unless cancelled and are subject to separate subscription terms. We may remove or suspend listings that breach these Terms, receive credible complaints, fail to pay, are unlicensed or contain prohibited content.

7. Payment Terms (Advertiser Subscriptions)

Pricing is as displayed on our website or in the applicable Listing Agreement and is in Australian Dollars, exclusive of GST unless stated. Pricing is subject to change with 30 days notice. Payments are processed by Stripe (PCI-DSS Level 1 certified) via secure encrypted transactions. HALP does not store complete credit card numbers.

Subscriptions auto-renew unless cancelled. Cancellation takes effect at the end of the current billing period. There are no refunds for voluntary cancellations or unused time; pro-rata refunds may apply for technical issues that prevent service access, and are processed within 14 business days. If payment fails we may attempt to reprocess it, suspend the account after 7 days and remove the listing after 14 days.

8. Intellectual Property Rights

All content and materials on our platforms are owned by HALP or licensed to us, including our logos and trademarks such as "HALP", "House And Land Packages" and "Boutique Developments", website design, code, data compilations and school-zone aggregations. We grant you a limited, non-exclusive, non-transferable, revocable licence to use our platforms for personal, non-commercial purposes.

When you submit content (reviews, testimonials, forum posts) you retain ownership but grant us a worldwide, royalty-free licence to use, reproduce, modify and display it. If you believe content on our platform infringes your copyright, contact legal@halp.com.au.

9. Disclaimers and Limitations

HALP does not provide financial, mortgage, legal, tax, real-estate or investment advice. Calculators and tools provide estimates only. We facilitate connections but do not control third-party conduct or guarantee third-party services or outcomes. Information may contain errors or be outdated. We do not guarantee uninterrupted or error-free operation.

10. Limitation of Liability

To the maximum extent permitted by law, HALP and its directors, officers, employees and agents are not liable for loss of profits, revenue, data, business opportunities or the cost of substitute services, nor for consequential, incidental, special or punitive damages arising from your use or inability to use our services, errors in content, third-party conduct, unauthorised access or service interruptions. Where liability cannot be excluded our total liability is capped at $100 AUD for free services, or for paid services the lesser of $1,000 AUD or the amount you paid in the prior 12 months.

Nothing in these Terms excludes, restricts or modifies any consumer guarantees, rights or remedies under the Australian Consumer Law that cannot be excluded. Where the ACL applies, our liability for breach is limited (at our option) to re-supplying the services or paying the cost of having them re-supplied.

You agree to indemnify HALP from any claims, damages, losses and expenses arising from your breach of these Terms, violation of law or third-party rights, use of our services, content you submit, or interactions with other users or third parties.

11. Dispute Resolution

Before initiating legal proceedings you agree to contact legal@halp.com.au with details of your dispute and allow 30 days for informal resolution. These Terms are governed by the laws of New South Wales, Australia and you submit to the exclusive jurisdiction of NSW courts. Optional arbitration in Sydney under ADRA rules is available. To the extent permitted by law you agree to resolve disputes individually and waive class-action participation. Nothing prevents either party from seeking injunctive relief for IP infringement, breach of confidentiality or irreparable harm.

12. General Provisions

These Terms, together with our Privacy Policy, constitute the entire agreement. If any provision is invalid the remainder continues in force. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our written consent; we may assign to an affiliate or in a merger or sale of assets. Notices to you may be sent by email, website posting or in-app notification. 13. Special Terms for Specific Services

Our mortgage calculators provide estimates only and should not replace professional financial advice. School zone data is provided for research purposes only; verify with the education department and the school before relying on it. Property alerts are subject to your preferences and can be modified or cancelled anytime. Mortgage broker referrals may earn HALP a referral fee; brokers are independent third parties, must be licensed and must comply with responsible lending laws.
